I just learned that Texas officials dropped cases involving ANOTHER 29 FLDS children today. So in two days, they have closed cases involving 58 children.
Patrick Crimmins, spokesman for the Texas Department of Family and Protective Services, said still pending are cases involving 72 of the 439 children originally removed from the Yearning For Zion Ranch in Eldorado.
In an email, Crimmins said: ''As a reminder, a nonsuit ends the lawsuit, or legal case, because court supervision is no longer considered necessary to ensure a child's safety. Nonsuits can be filed for a variety of reasons. We may have completed an investigation and no abuse or neglect occurred; it could also be that we have decided that even though abuse or neglect has occurred, one or both parents or another suitable family member can ensure the child’s protection.''

Why, what probable cause, can CPS adduce to justify continued intervention? There MUST be probable cause to intervene, and it MUST be on a family by family basis. That is probably why they are non-suiting so fast, they don't want to face that lurking question: WHY?
In the Gates case, there were allegations of physical abuse of those specific children in that specific family, false allegations, and some shoddy testimony from the kids themselves. Point being, there was SOMETHING, even if a lame pretext, to justify the intervention in that family. CPS has so far only listed anything remotely resembling probable cause in a bare handful of families. All the rest of the families, the vast majority, have been acted upon WITHOUT citing probable cause. It's time for some accountability. Every innocent family, who was never accused of anything beyond mere FLDS affiliation and YFZ residence, needs to SUE the case workers who dragged them into this humiliating, painful, investigatory process.
I'm with you Z - The only way the State and CPS respects a family's Constitutional rights and religious freedoms if for there to be a HEAVY penalty for breaking their own laws and guidelines.
I know the FLDS have turned their cheeks in the past and that has brought them to this point.
I hope they will take a stand and say, "No more."
The damage done to the next generation of their culture has been immense. We hear about one or two children and mothers and the trauma they suffered, but the vast majority of their stories will go untold.
I hope there is someone recording all of this who will write a book about it - a lawyer would be great!
And, I do think the individual caseworkers who LIED to the mothers and the children need to be held accountable for the pain and suffering of both mothers and childrens - If I were one of the mothers and I could hear my child screaming for me - that would ring in my ears the rest of my life. I cannot fathom how a child ever feels secure after that type of betrayal by authority figures.
I really pray for the mental and emotional healing of these people - all of them. The fathers too, who were under house arrest although never charged with any crimes.
What right did CPS/Walther have to take the phones away from women/children who were NOT under arrest?
This thing was wrong on so many levels....
As important as each individual story is, and as important as the larger story of what happened at YfZ Ranch is, we cannot allow our concern for the particulars of this to be so large that we forget the real, underlying horror.

When government gets so insulated and removed from the realities of the human beings they serve that they believe, even for a split second, that they can interupt the lives of an entire community in such a devastating, traumatic, violent, and all encompassing manner, then it is time to change that government and carefully train and monitor all new appointments to assure those conditions never occur again.
Not only do the individuals who were harmed by this need to hold CPS and the State of Texas accountable in any and everyway possible, the good people of Texas need to rally and also demand accountability and public correction of what are clearly systemic problems on steroids!
You have in Texas a government to be truly feared. And you have a set of citizens who do not see this as problematic. For me, that is extraordinarily scary!
Brooke, a minor correction to your post. Nonsuiting the cases does not necessarily mean that CPS has closed their investigation. All it means is that they are not, at this time, going forward with the court case.
They can refile these cases at any time that they believe that it is necessary.

Does a non-suited case retain that status indefinitely? Is there any point in time that is automatically closed due to non action?

The CPS attitude is that EVERYONE in the country is under suspicion and investigation. How else can you justify all this CPS activity when there is no complaint of abuse (the phone call was a hoax) and there is no proof that children are being sexually or physically abused?
If this is not a violation of peoples civil rights, then what is?
By the way, how do you prove someone is not a child abuser and non-suit them anyway? It's all circumstantial and hearsay.
It's like asking Hitler if he thinks the Jew across town doesn't abuse his/her child and should be non-suited.

In this case, CPS claimed that the punishment of one child was emotional abuse, and since there were 13 (adopted) children who witnessed it, that was 13 cases of abuse, and because the wife did nothing that was another 13 cases of abuse. 26 cases of abuse, so they took all the children. The MO of CPS has not changed one bit in the past eight years.

silver, orders in Texas become final 30 days after being signed by the judge. Despite what TBM thinks, after that point, CPS canNOT re-file the case based on the same facts. There would have to be new allegations phoned in by Rozita in order for them to file a NEW case.

Silver, as Riki said, the order becomes final in 30 days. However, with the addition of any single (or more) fact, CPS can re-file (or technically initiate a new proceeding). The fact can be based on their ongoing investigation, which is completely separate from any court action. This fact can be something as simple as resistance to teaching the children at risk how to recognize abuse...

A non-suit does not mean that CPS has made a determination that there was not abuse.

It's not all that clear.
Broadness TBM, broadness. The warrant was too broad. The executors of the warrant *knew* they were searching and seizing upon multiple families' places of residence. Even you must admit that a separate warrant should have been issued for each family.
As for the Temple, the probable cause, if any, to search it was very weak. Whatever found in it could be thrown out in a heart beat.
