"266. What percentage of the male children in that school have completed high school?"
One would expect 0%, if they are still IN the school...
Why do so many of the questions not actually quite make sence?
So out of nearly 300 questions, Merril noded or grunted or allowed his attorney to answer 70 for him.
They forgot the really relevant question:
Temple garments - boxers or briefs?
What the heck is "R23"? Does that refer to a person? A location?
What do most of these have to do with Malonis' client? Who helped Malonis compile these questions?
Im assuming R23 could be the other land that was bought in Texas.
Well at least she didn't ask if hew knew where the crematoriums were.
Who helped Malonis compile these questions
Good question. And apparently Malonis has some pretty good disovery privileges, unless all the AAL's were entitled to all that evidence?
Maybe she has a snitch in the state office.
Gee this thing is starting to smell worse than the Rod Blogojevich affair.
245-247 about the storehouse. Are they referring to the bishops storehouse?
A lot of the questions like these and "what is an ordinance?" could be answered with a small amount of research into Mormonism.
Bishops storehouse is essentially the church's welfare system. Many of the wares and goods are provided by service projects where members sew blankets & clothing, knit hats, put together grooming kits, etc. and give them to the church. Large community gardens are raised, harvested and processed with the food given to the bishops storehouse. Tithing and other financial contributions are also used to stock the bishops storehouse with items they can't make or raise themselves (like salt, etc.).
I think they asked who can buy things there? Nothing is purchased from the bishops store house. Remember it's part of a welfare program. It's for people in need. They explain their need to the leadership who then distribute the items from the storehouse that the family or individual is in need of. Going through the leadership is necessary first to manage the resources of the storehouse and second to be aware of the families or individual's cirumstances so that other assistance can be put into play if necessary. It's meant to be a short-term help for families who have experienced job loss, illness, etc. while they get on their feet.
Since the Mormon church is world-famous for its private welfare system and the term "Bishops Storehouse" is commonly used in articles about it I'm surprised at the questions about it.
All the questions about child abuse. I thought those questions had already been asked and answered during the CPS investigation and hearings. I guess since their investigation didn't yield the answers they wanted they're going to just keep on asking hoping to finally get the response they're looking for?
Every child on the ranch was examined by a medical doctor, tested academically and interrogated as to their home lives. Wasn't that enough to convince them there was no "water boarding", force feeding, etc.?
It just makes the state look like a bunch of idiots to keep going there.
Kurt's looking for documented evidence that the girls from the ranch had to undergo gyno exams. If anyone has any information on that, it would help to settle that issue once and for all.
Harley: So out of nearly 300 questions, Merril noded or grunted or allowed his attorney to answer 70 for him.
Here's something to chew on--I attended a presentation given by a family law attorney & a criminal defense attorney who partner together, on how attorneys can best protect their client's interests when CPS &/or law enforcement is involved in their family: Take the 5th to everything.
Riki
That's clearly one strategy; however, I'd count on the kids being in CPS custody for 12 to 18 months.
Most folks aren't so bad that they need to rely on that strategy.
There is not one uber strategy. It really depends upon the case.
Ron, the impression I got from these attorneys is that this particular situation happens more often than people think, & that there is more at stake in the criminal case than the civil. Anyway, I thought it was interesting, given all the arm-chair Matlocking going on around here. ;)
Riki, when Merril was ask if he would like to see his daughter, and his attorney said he was taking the 5th, NOT merril but his attorney.
What jeopardy was there, NOT to answer the question. Admitting he wanted to see his daughter he hasn't seen since april is incriminating? Give me a break!
Harley, it's incriminating because it's an implicit admission that Merrianne is indeed his daughter.
Harley, I'll take the word of experienced attorneys over your opinion any day of the week. Something tells me they know what they're talking about.

Unless it's Ron or Blues. Then we better get a 'second opinion'! I'm not sure they know what they're talking about.LOL (just kidding boys)
Ron, the real question are you bald and toothless????

If you go by supreme court decisions, the more times you take the fifth the better, as fewer inferences can be made about any particular non-answer.
First Amendment
They have the girl's birth certificate, naming who her mother and father are, so taking the fifth would be stupid.

If you take the fifth about even stupid things, then it becomes very difficult to logically infer anything from any non-answered question. Think of the most extreme case: if you're arrested you're told that you have the right to remain silent and not answer questions. Even when the answer is stupidly obvious to everyone. Where does that right come from? The fifth amendment!
That MJ took the fifth 250+ times totally dilutes the effect of it on any one question. If he'd only taken the fifth once or twice, you could point to those non-answers and say, aha!

On that token then asking the question is equally as stupid, as is your comment!
First Amendment said: "Where does that right come from? The fifth amendment!
Actually, First Amendment, the "right" is "unalienable" and "comes from God". The Fifth Amendment is binding upon the government, restricting it from trying to deprive individuals of their right!
