The hit on Hilder

Barack Obama may have been elected president and the nation's government as a whole may be tacking back toward the political center, but guns freaks still call the shots in Utah.

The Utah Senate refused to confirm Third District Judge Robert Hilder — who is held in high esteem by the legal community — to the Utah Court of Appeals. The Utah Senate voted Hilder down by 16 to 12. The vote was also a slap to Gov. Jon Huntsman who nominated Hilder.

In the minds of many senators, Hilder's main failing was that he ruled five years ago to allow the University of Utah to ban guns on campus. Actually, Hilder's mistake was that he thwarted Utah's gun groups. Before the special senate confirmation session, gun rights supporters fired volley after volley of form letters and e-mails at lawmakers, saying the judge is anti-gun.

Sen. Mike Waddoups, the so-called "Father" of Utah's liberalized gun laws — who will soon be Senate president, threw up a smokescreen, telling senators that Hilder had been uppity (Waddoups accused the judge of having an "aggressive nature") when he came before the Senate Judicial Confirmation Committee.

It made me very uncomfortable. He has a temper he has not learned to control.

How dare that "uppity" judge disagree with the high and holy elders of the Lege! Here's the article interpreted by the patented rdale method, so those of us who aren't gunz-crazed can understand what motivates these guys:

Guns don't kill:

"SWAN LAKE, N.Y. - An upstate toddler is dead and a New York City man is charged with manslaughter after a hunting accident in the Hudson Valley.

The Times Herald-Record of Middletown reports that Edward Taibi of Queens was hunting Sunday afternoon in rural Sullivan County when he shot a deer and then fired again about 400 feet away from a mobile home.

A 16-month-old girl in the home was hit in the upper body. She was flown to Westchester Medical Center, where she died. The child's name was not released.

State police have charged 45-year-old Taibi with second-degree manslaughter. Police are still investigating."

I hope he's convicted and does slam time.

All guns and all gun-idiots should be outlawed.

Guns exist for only one reason: to kill, and in this case, success!

Who cares whether he was held in high regard by the legal community. We all know the tragedy of a plane that crashes when it is half-filled with attorneys -- it was only half full.

We have too many attorneys and a convoluted legal system designed to serve the legal system and not the public.

In my experience Judge Hilder is an outstanding man. He presided over a case that involved my children and the lawyer of the defendant was stammering for 6 months about what to do, he finally called him on it and the case ended within a week. He upholds the law, regardless of the political ramifications and ramblings of the naysayers around him. He is outstanding.

To the Anonymous who asks "who cares whether he is held in high regard by the legal community?" the answer is because they know the law and what he is capable of as a judge.

Yes, there are lots of lame jokes out there about lawyers (thanks a lot for repeating one we have all heard too many times) but our legal and government system still operate with the help of lawyers and judges. Perhaps you would like to go back to the "hang em high" mentality of the old west.
